YOUTH SPORTS TRAINING LIABILITY WAIVER AND HOLD HARMLESS

AGREEMENT

This Youth Sports Training Liability Waiver and Hold Harmless Agreement (the

"Agreement") is executed by the undersigned parent or legal guardian ("Participant" or

"Guardian") of the child ("Minor") named above, in favor of NXTLETE LLC, a limited

liability company, its employees, agents, contractors, officers, directors, and affiliates

(collectively, "NXTLETE").

1. Acknowledgment of Risk:

I, the undersigned, acknowledge that participation in sports training activities, including

but not limited to physical exercise, training drills, games, and related activities

(collectively, the "Activities"), carries inherent risks of injury, including serious bodily

injury, permanent disability, and death. I acknowledge that these risks may arise from

the Minor's own actions, the actions or negligence of others, or the condition of the

facilities or equipment used. I further acknowledge that NXTLETE has made me aware

of these risks, and I voluntarily assume all such risks.

2. Waiver and Release:

In consideration for the Minor’s participation in the Activities, I, for myself, my heirs,

executors, administrators, and assigns, do hereby release and forever discharge

NXTLETE, its owners, employees, agents, contractors, officers, directors, and affiliates,

from any and all claims, demands, actions, causes of action, liabilities, damages, or

losses, including but not limited to personal injury, death, or property damage, arising

out of or in any way related to the Minor’s participation in the Activities, even if caused

by the negligence or fault of NXTLETE.

3. Hold Harmless Agreement:

I agree to indemnify, defend, and hold harmless NXTLETE, its owners, employees,

agents, contractors, officers, directors, and affiliates, from and against any and all

claims, actions, suits, procedures, costs, expenses, damages, or liabilities, including

reasonable attorney fees, arising out of or in any way related to the Minor’s

participation in the Activities, including any claims made by third parties.

4. Medical Authorization:

I hereby give permission to NXTLETE to seek medical treatment for the Minor in the

event of an emergency during participation in the Activities. I understand that I am

responsible for all medical costs incurred as a result of any injury to the Minor.

5. Media Release:

I grant permission to NXTLETE to photograph, videotape, or otherwise capture the

Minor’s participation in the Activities and to use such media in promotional materials,

on social media, or for other lawful purposes. I waive any claims for compensation or

any right to inspect or approve the final product.

6. Governing Law:

This Agreement shall be governed by, and construed in accordance with, the laws of

the state of Texas where NXTLETE LLC is based, without regard to its conflicts of laws

principles.

7. Entire Agreement:This Agreement contains the entire understanding of the parties with respect to the

subject matter hereof and supersedes all prior or contemporaneous oral or written

agreements or understandings related to the subject matter. Any amendments or

modifications to this Agreement must be in writing and signed by both parties.

8. Terms and Conditions:

• Summer Classes are non-transferable & non-refundable unless specified.

• Athletes & Families must comply with gym rules and staff instructions.

• Misconduct, harassment, or unsafe behavior may result in termination without refund.

• NXTLETE is not responsible for lost, stolen, or damaged personal items.

• Children under 16 must be accompanied or in supervised programs.

• Partial Refunds will be given based off of % days left in month.

• Proper attire and shoes must be worn at all times.

9. Parent/Guardian Certification:

I certify that I am the legal parent or guardian of the Minor, and that I have the legal

right to consent to the Minor’s participation in the Activities and to execute this

Agreement on behalf of the Minor.

By signing below, I acknowledge that I have read, understood, and voluntarily agree to

the terms of this Youth Sports Training Liability Waiver and Hold Harmless Agreement.
